"Get Mic'd Up" Contest

NO PURCHASE NECESSARY
PROMOTION DESCRIPTION: The "Get Mic'd Up" Contest (the "Contest") begins on August 20, 2010 at 12:01 a.m. Central Time ("CT") and ends on November 27, 2010 at 11:59 p.m. (the "Promotion Period"). By participating in the Contest, each entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of Mobile Event Media, LLC ("Sponsor"), 118 Fallbrook, Murphy, TX 75094, which shall be final and binding in all respects.
ELIGIBILITY: Only legal residents of the state of Texas are eligible to enter. Potential winners of the Contest may be required to show proof of residency. Persons in the following categories are NOT eligible to participate or win a prize in the Contest: (a) Sponsor, their respective parents, subsidiaries, affiliates, dealers, service agencies and independent contractors, and each of their respective directors, officers, employees and agents (collectively, the "Promotion Entities"); (b) persons engaged in the development, production or distribution of materials for this Contest; and (c) persons who are immediate family members (defined as spouse or biological or step- mother, father, sister, brother, daughter, or son and each of their respective spouses) of any person in any of the preceding categories, regardless of where they live, and/or individuals who reside in the same household, whether related or not, as any person in any of the preceding categories. The transfer of a prize from an ineligible to an eligible person is strictly prohibited.
HOW TO ENTER: To enter the Contest, you will be required to submit a video based on a pre-determined script outline, whose total length may not exceed one minute and thrity seconds (90 seconds). The script outline and complete contest rules are available at www.HighSchoolRoadTour.com. There are two methods of entry into the Contest, 1) log on to the web site located at www.HighSchoolRoadTour.com (the "Website"), click on the "Get Mic'd Up" icon and then follow the on-screen instructions to complete the entry form and upload your completed video, or 2) log on to www.HighSchoolRoadTour.com for a schedule of event stops of the "FSN High School Road Tour" and attend one of the listed events at the designated date and time (at entrants own expense) and have a Road Tour representative record and submit your entry while on-site. Sponsor is not liable if listed event is cancelled, changed or incorrectly listed on www.HighSchoolRoadTour.com. No other method of entry will be accepted.
All video submissions (the "Submission") are pursuant to the Video Submission Requirements as outlined below.
- Submission must not exceed one minute and thrity seconds (90 seconds) in length.
- Submission must be original and entrant must have full creative rights to all elements included in the Submission.
- Submissions should not include any licensed music, likenesses, or other materials that require any pre-approvals prior to use on web or on air.
- Submission must be performed by entrant, unless a minor, then legal guardian may serve as agent for entrant.
- Submission must be created using the English language.
- Submission must be created in one of the following recognized formats: .avi, .mov, .mpeg and .wmv.
- Submission may not exceed a file size of 15 mb.
- Submission must follow the designated script outline and should not contain any objectionable language, background materials or on-screen graphics that are deemed inappropriate.
Limit one (1) entry per email address. Children must get permission from their parent or legal guardian to enter.
All submissions ( "Submissions") must meet the "Submission Requirements" set forth above (any Submission that, in Sponsor's good faith judgment, violates the criteria will be disqualified and/or discarded): The Submission must (i) be owned exclusively by entrant; (ii) not have been previously published, released or distributed commercially; (iii) not infringe on any third party intellectual property rights, or violate any law, and as of the date of the Submission, not be the subject of any actual or threatened litigation or claim; and (iv) be suitable for publication (i.e., not obscene, provocative, offensive, indecent, defamatory or libelous). Submissions that do not conform to these requirements will be disqualified. Proof of entering information at the Website is not considered proof of delivery to or receipt by Sponsor of entry. Entrants must provide a valid email address to be eligible. In the event of a dispute regarding the individual who actually submitted an entry through the Website, the entry will be deemed submitted by the authorized account holder of the email address supplied at the time of entry. "Authorized account holder" is defined as the natural person to whom the applicable email address has been assigned by the Internet Access Provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the address submitted. The potential winner may be required to provide Sponsor with proof that he/she is the authorized account holder of the email address associated with the winning entry. If a dispute as to the identity of any entrant (online or otherwise) cannot be resolved to Sponsor's satisfaction, the entry will be deemed ineligible. The Promotion Entities shall not be responsible for incorrect or inaccurate entry information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error or any other intentional, casual or inadvertent misconduct which may occur in the processing of the entries in the Contest. The Promotion Entities assume no responsibility or liability for any error, omission, interruption, deletion, theft or destruction, or unauthorized access to, or alteration of entries. The use of any device to automate the entry process is prohibited. No mechanically reproduced, illegible, incomplete, forged, software-generated or other automated multiple entries will be accepted. Sponsor reserves the right in its sole discretion to disqualify any individual who is found to be tampering with the entry process or the operation of the Contest, to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike-like or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Contest. Information collected in connection with this Contest will be used by Sponsor in accordance with its online privacy policy, which can be found at www.HighSchoolRoadTour.com. All eligible entries that are received will be entered for a chance to win. All Submissions received by Sponsor becomes the property of Sponsor, its licensees, assignees, and agents and may be used, adapted, edited and/or modified, and published by Sponsor in any media now known or hereafter devised, including without limitation, telecast on the Network, and posting on the Website.
*WINNER SELECTION AND WINNER NOTIFICATION: There will be one (1) Grand Prize Winner selected. Entries will be accepted beginning August 20, 2010 at 12:01 a.m. Central Time ("CT") through November 7, 2010, at 11:59 p.m., this period is defined as the "Submission Period". Beginning November 8, 2010 at 12:01 a.m. Central Time ("CT") through November 27, 2010, at 11:59 p.m., defined as the "Active Voting Period", entries posted to www.HighSchoolRoadTour.com will be able to receive votes. Votes may be cast by any individual who has a valid email address and visits www.HighSchoolRoadTour.com and follows the on-screen voting instructions. Votes will be limited to ten (10) per day, per valid email address. At the conclusion of the Active Voting Period, the top five (5) Entries will be designated as Finalists. In the event of a voting tie, all entries tied with the fifth most votes will advance, along with the top four vote receiving Entries, as Finalists. There is no limit to the number of Entries that may tie for the fifth most votes. On or about November 29, 2010, the Grand Prize Winner will be selected from the qualifying Finalists by a panel of judges as determined by Sponsor. Panel will consist of three (3) individuals who will judge entries on following the script guideline for content and professional presentation standard of performance by the entrant of the submission. The potential Grand Prize Winner will be notified by telephone and/or e-mail using the contact information given at the time of entry. Sponsor shall have no liability for any winner notification that is lost, intercepted or not received by a potential winner for any reason. If, despite reasonable efforts, the potential Grand Prize Winner does not respond within three (3) days of the first notification attempt, or if the prize or prize notification is returned as unclaimed or undeliverable to such potential winner, such potential winner will forfeit his or her prize and an alternate winner will be selected. If any potential winner is found to be ineligible, or if he or she has not complied with these Official Rules or declines a prize for any reason prior to award, such potential winner will be disqualified and an alternate winner will be selected. Sponsor will successively attempt to contact up to three (3) potential winners of the Grand Prize in accordance with such procedure. If there is still no confirmed winner of the prize in question after such attempts have been made, the prize will go unawarded.
PRIZES/ODDS: One (1) Grand Prize is available to be awarded. Grand Prize Winner will receive two (2) nights hotel (hotel to be selected by Sponsor) in a double occupancy room on December 17th and 18th in Dallas, TX or surrounding area (city subject to change based on telecast schedule), a check for One Thousand Dollars ($1,000), an opportunity to appear on-air during an FSN High School Football telecast, and tickets to that event for winner and three guests. The Approximate Retail Value ("ARV") of Grand Prize is One Thousand Four Hundred Dollars ($1,420). No cash alternative or prize substitutions will be allowed, except Sponsor reserves the right to substitute prize(s) of comparable value if the prize listed is unavailable for any reason. Any other expenses not specified herein, will be the sole responsibility of the winner including, without limitation, ground transportation to and from the opportunity to appear on-air and the event to which tickets are awarded, food, beverages and alcoholic beverages. Event tickets are non-transferable and will be deemed void if sold, transferred, auctioned or assigned to any third person. Tickets are subject to all terms and conditions generally applicable thereto. In the event the Grand Prize Winner or his or her guests engage in behavior that (as determined by Sponsor in Sponsor's sole discretion) is obnoxious or threatening, illegal or that is intended to annoy, abuse, threaten any other person, Sponsor reserves the right to terminate the applicable event early, in whole or in part, and send the winner and/or his or her guest(s) home with no further compensation. All minors must be accompanied, at all times at event, by an adult. Odds of winning depend on the number of eligible entries received.
GENERAL PRIZE CONDITIONS: The prize winner shall be solely responsible for all federal, state and/or local taxes, and the reporting consequences thereof, and for any other fees or costs associated with the prize. Each potential Grand Prize Winner will be required to execute an Affidavit of Eligibility, a Liability Release, and (where legal) a Publicity Release (collectively, "Prize Claim Documents"). If a winner is not of legal age of majority in his or her state of residence (a "minor"), at Sponsor's option, the applicable prize either will be awarded in the name of parent or legal guardian of winner, or parent or legal guardian of winner will be required to ratify and sign Prize Claim Documents. If a winner (or, in the case of a minor, such minor winner's parent or legal guardian) fails or refuses to sign and return all Prize Claim Documents within five (5) days of prize notification, the winner may be disqualified and an alternate winner may be selected. If Sponsor so elects, a potential prize winner may be required to submit to a confidential background check to confirm eligibility and help ensure that the use of any such person in advertising or publicity for the Contest will not bring Sponsor into public disrepute, contempt, scandal or ridicule or reflect unfavorably on the Contest as determined by Sponsor in its sole discretion. Verified winner hereby agrees and grants Sponsor the right, but not the obligation, to the use of her or his Attributes (as defined above) in any and all media, now known or hereafter devised, without notice, review or approval, in perpetuity and throughout the universe for advertising and promotional purposes in connection with the Contest and other promotions without further compensation, and releases Sponsor from all claims arising out of the use of such Attributes.
GENERAL LIABILITY RELEASE/FORCE MAJEURE: Entrants (and any minor entrant's parent or legal guardian) agree that the Promotion Entities (A) shall not be responsible or liable for, and are hereby released from, any and all costs, injuries, losses or damages of any kind, including, without limitation, death and bodily injury, due in whole or in part, directly or indirectly, to participation in the Contest or any Contest-related activity, or from entrants' acceptance, receipt, possession and/or use or misuse of any prize, and (B) have not made any warranty, representation or guarantee express or implied, in fact or in law, with respect to any prize, including, without limitation, to such prize's quality or fitness for a particular purpose. Sponsor assumes no responsibility for any damage to an entrant's computer system which is occasioned by accessing the Website or otherwise participating in the Contest, or for any computer system, phone line, hardware, software or program malfunctions, or other errors, failures, delayed computer transmissions or network connections that are human or technical in nature. Without limiting the generality of the foregoing, Sponsor is not responsible for incomplete, illegible, misdirected, misprinted, late, lost, damaged, stolen, or postage-due submissions or prize notifications; or for lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet service providers, websites, or other connections; or for miscommunications, failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions; or for any technical malfunctions, failures, difficulties or other errors of any kind or nature; or for the incorrect or inaccurate capture of information, or the failure to capture any information. Sponsor reserves the right in its sole discretion to disqualify any individual who is found to be tampering with the entry process or the operation of the Contest or the Website, to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike-like or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Contest, or to annoy, abuse, threaten or harass any other person, and Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. Sponsor reserves the right to modify, extend, suspend, or terminate the Contest, in whole or in part, if it determines, in its sole discretion, that the Contest is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or other causes beyond Sponsor's control have destroyed or severely undermined or to any degree impaired the integrity, administration, security, proper play and/or feasibility of the Contest as contemplated herein. In the event Sponsor is prevented from awarding prizes or continuing with the Contest as contemplated herein by any event beyond its control, including but not limited to fire, flood, natural or man-made epidemic of health of other means, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal state or local government law, order, or regulation, public health crisis (e.g., SARS), order of any court or jurisdiction, or other cause not reasonably within Sponsor's control (each a "Force Majeure" event or occurrence), then subject to any governmental approval which may be required, Sponsor shall have the right to modify, suspend, or terminate the Contest in its entirety. If the Contest is terminated before the designated end date, Sponsor will (if possible) select the winner in a random drawing from all eligible, non-suspect entries received as of the date of the event giving rise to the termination. Inclusion in such drawing shall be each entrant's sole and exclusive remedy under such circumstances. Only the type and quantity of prizes described in these Official Rules will be awarded. If, for any reason, more bona fide winners come forward seeking to claim prizes in excess of the number of each type of prize set forth in these Official Rules, the winners, or remaining winners, as the case may be, of the advertised number of prizes available in the prize category in question may be selected in a random drawing from among all persons making purportedly valid claims for such prize(s). Inclusion in such drawing shall be each entrant's sole and exclusive remedy under such circumstances. These Official Rules cannot be modified or amended in any way except in a written document issued in accordance with law by a duly authorized representative of Sponsor. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
OFFICIAL RULES/WINNER LIST: Complete Contest Rules, and upon selection and verification, a listing of Grand Prize Winner, will be available at www.HighSchoolRoadTour.com through December 31, 2010.
